Vacancy in office
67 Vacancy in office
A person who is a Board member of a Local Aboriginal Land Council vacates office if the person—
dies, or
is absent from 2 consecutive meetings of the Board or the Council of which reasonable notice has been given to the person personally or by post, except on leave granted by the Board or unless the person is excused by the Board for having been absent from those meetings, or
completes a term of office and is not re-elected, or
resigns the office by instrument in writing addressed to the Council, or
becomes disqualified from holding office as a Board member under this Act, or
is removed from office by the Council for the breach of a dismissal provision of a code of conduct under section 182, or
is removed from office by the Registrar under Part 10, Division 4.
A vacancy does not arise under subsection (1)(b) until the Board has—
given the member reasonable notice of the Board’s intention to consider at a meeting of the Board whether to excuse the member for the absences, and
resolved at the meeting not to excuse the member for the absences.
