Community Gaming Regulation 2020

A prize winner who is determined to have won a prize in a gaming activity may be awarded a substitute prize that is different to the prize specified by the rules of the gaming activity if—

the specified prize is not available because of unforeseeable or other special circumstances, and

the substitute prize is similar to the specified prize, and

the substitute prize is of equal or greater value than the specified prize.

However, if the value of the specified prize exceeds $100,000, a substitute prize must not be awarded unless, before the prize winners are determined, the participants in the gaming activity have been—

given written notice of the substitute prize, and

offered the opportunity to choose whether to—

continue to participate in the gaming activity, or

cease to participate in the gaming activity and to receive a refund of any entry fee paid to participate.
