24 Appointment to new offices
On the commencement date—
the person holding office as the Chief Magistrate immediately before the abolition of the office is appointed as the Chief Judge of the Local Court, and
a person holding office as a Deputy Chief Magistrate immediately before the abolition of the office is appointed as a Deputy Chief Judge of the Local Court, and
a person holding office as a Magistrate immediately before the abolition of the office is appointed as a Judge of the Local Court, and
a person acting as a Magistrate immediately before the abolition of the office of Magistrate is appointed to act as a Judge of the Local Court.
A person referred to in subclause (1) is taken to hold the new office, or to act in the new office, subject to the terms and conditions, including remuneration, that applied to the person’s former office immediately before the commencement date.
A person referred to in subclause (1)(d) is appointed to act as a Judge for the remainder of the term for which the person was appointed to act as a Magistrate.
Unless the contrary intention appears, a person’s service in a former office must be reckoned for all purposes as service in the person’s new office corresponding to the former office.
To avoid doubt, the appointment under subclause (1) does not require a further commission under the public seal of the State.
