Mining Act 1992

Any proceedings that had been commenced under the Mining Act 1973 in a Warden’s Court but had not been finally dealt with before the relevant commencement are to continue to be dealt with in accordance with this Act.

Any decision of a Warden’s Court under the Mining Act 1973 and in force immediately before the relevant commencement is taken to be a decision of a Warden’s Court under this Act.

Any order or injunction made or granted by a Warden’s Court, or by a warden, under the Mining Act 1973 and in force immediately before the relevant commencement is taken to be an order or injunction made or granted under this Act.

Any writ of execution issued by a Warden’s Court under the Mining Act 1973 and in force immediately before the relevant commencement is to be enforced as if this Act had not been enacted.

Any authorisation granted by a Warden’s Court, or by a warden, under the Mining Act 1973 or the Coal Mining Act 1973 and in force immediately before the relevant commencement is taken to have been granted under this Act.

Any summons or subpoena issued by a Warden’s Court, or by a warden, under the Mining Act 1973 and in force immediately before the relevant commencement is taken to have been issued under this Act.
