Centre based service taken to be QEC approved service if licence not revoked or suspended
247 Centre based service taken to be QEC approved service if licence not revoked or suspended
This section applies if immediately before the commencement—
a person held a licence for a centre based service under the repealed Act that is not revoked or suspended; and
the centre based service is a QEC service to which this Act applies.
On the commencement—
the service becomes a QEC approved service; and
the person becomes—
an approved provider; and
the holder of a service approval for the service; and
subject to subsection (3), the provider approval and service approval are subject to the conditions, relevant to each approval, that applied to the licence immediately before the commencement.
However, for a condition that applied to the licence immediately before the commencement, the chief executive may decide that the condition—
does not apply to the provider approval and service approval from the commencement; or
will instead be the subject of the service waiver or temporary waiver the chief executive considers appropriate from the commencement.
