182 Emergency order prevails
In this section—
designated
Act means any of the following:
the
Aboriginal
Heritage Act 1988;
the
Animal
Welfare Act 1985;
the
Aquaculture
Act 2001;
the
Dog and Cat Management Act 1995
the
Environment
Protection Act 1993;
the
Fisheries
Management Act 2007;
the
Heritage
Places Act 1993;
the
Landscape
South Australia Act 2019;
the
Local
Government Act 1999;
the
Marine
Parks Act 2007;
the
Mining
Act 1971;
the
National
Parks and Wildlife Act 1972;
the
Native
Vegetation Act 1991;
the
Pastoral
Land Management and Conservation Act 1989;
the
Phylloxera and Grape Industry Act 1995;
the
Veterinary
Practice Act 2003;
the
Wilderness
Protection Act 1992;
any other Act specified by the regulations as being included within the ambit of this definition.
An emergency order prevails, to the extent of any inconsistency, over the following:
the regulations;
a registration, authorisation, approval, exemption or other right or instrument granted, or in effect, under this Act;
a permit granted or in effect under this Act, other than an emergency permit given in relation to the emergency that is the subject of the emergency order;
a biosecurity program or biosecurity control agreement made, or in effect, under this Act;
a control order;
a biosecurity direction, other than an emergency biosecurity direction given in relation to the emergency that is the subject of the emergency order;
a provision of a designated Act.
Subsection (2)(g) applies despite the provisions of the designated Act.
