140 Burden of proof
In proceedings before the Tribunal –
the onus of proving an initial entitlement to a payment of compensation, or the payment of expenses, lies on the person claiming the entitlement; and the onus of proving that a person is no longer entitled to a payment of compensation, or for the payment of expenses, lies on the Commissioner.
