Part 12Dispute Resolution
Division 3Hearings

149 Orders

If the Tribunal makes a determination in respect of an application for referral made to it, the Tribunal is to make an order that gives effect to that determination.

The Tribunal may make a consent order in respect of a proceeding before it – on the written application of all the parties to the proceeding; and after considering the matters to be resolved in the proceeding and being satisfied that the parties properly understand those matters.

If the Tribunal makes an order in respect of an application for referral to it, other than a consent order under subsection (2), it is to provide a statement in writing of its reasons for making the determination to which the order relates.

An order made under subsection (1) is to direct that what is required to be done by the order is to be done within the time specified in the order.

If an order is made under this section, the Registrar, as soon as practicable after the order is made, must arrange to be served on all parties to the proceeding to which the order relates – a copy of the order; and if applicable, a copy of any statement provided by the Tribunal under subsection (3).
