59 Disclosure of information by members &c.
In this section – relevant person means – a person who is or has been – a council member or a commission member; or a member of the staff of the council; or a member of the staff of a commission; or an Australian legal practitioner assisting the council or a commission; and another person who has or has had access to information by virtue of that person’s office or employment under or for this Act.
A relevant person must not, either directly or indirectly, except in the performance of a function, or the exercise of a power, under or for this Act – make a record of, or divulge or communicate to another person, any information acquired by the relevant person by virtue of the relevant person’s office or employment under or for this Act; or make use of any such information; or produce to another person, or permit another person to have access to, a document provided under or for this Act. Fine not exceeding 50 penalty units or imprisonment for a term not exceeding 6 months, or both.
