2.03 Application to set aside for irregularity
The Court must not set aside any proceeding or any step in any proceeding or any document or order in any proceeding on the ground of a failure to comply with these Rules on the application of any party unless the application is made—
(a)
within a reasonable time after the applicant becomes aware of the failure; and
(b)
before the applicant has taken any fresh step (save for filing a notice of defence) after becoming aware of the failure.
