40 Delegation by the Authority or chief executive officer
The Authority, by instrument, may delegate to any of the following persons any function, duty or power of the Authority under this Act—
the chief executive officer;
an employee of the Authority;
a seconded staff member.
The chief executive officer, subject to any conditions or limitations to which the delegation is subject, may sub-delegate a function, duty or power delegated to the chief executive officer under subsection (1) to a person specified in subsection (3) if the instrument of delegation authorises its sub-delegation.
For the purposes of subsection (2), the following persons are specified—
an employee of the Authority;
a seconded staff member.
Sections 42 and 42A of the Interpretation of Legislation Act 1984 apply to a sub-delegation authorised by this section in the same way as they apply to a delegation.
