116 Prosecutions, time for commencing

(1)

A prosecution for an offence against a provision of Division 2, 3 or 4 of Part 7 in relation to a publication, film or computer game that is unclassified at the time of the alleged offence —

(a)

must not be commenced until the publication, film or computer game has been classified or the accused, by notice under section 141A, agrees that the publication, film or computer game if classified would have been the classification agreed; and

(b)

may be commenced not later than 12 months after the date on which —

(i)

the publication, film or computer game was classified; or

(ii)

the accused returned the notice under section 141A,

whichever is relevant.
