Electoral Act 1907

Unless this Act or another enactment provides otherwise, a person who —

has reached the age of 18; and

is not subject to any legal incapacity; and

is an Australian citizen; and

has resided in the State for one year; and

is an elector entitled to vote in an election in a district,

The reference in subsection (1)(e) to an elector entitled to vote in an election in a district includes a reference to a person if —

the person is entitled to be an elector enrolled to vote in an election in a district; and

the person’s name appeared on the register of electors or the person has made a claim for enrolment; and

by mistake, the Electoral Commissioner or an enrolment officer has omitted or removed the person’s name from the register of electors or has not included the person’s name on the register of electors.
