Authority may determine licence terms and conditions
11 Authority may determine licence terms and conditions
A licence is subject to any terms and conditions that are determined by the Authority.
Without limiting subsection (1), terms and conditions determined under that subsection may include provisions relating to any matter provided for by Schedule 1.
The terms and conditions of licences that —
have the same classification under section 4; and
have the same licence area or licence areas that overlap to a significant extent,
must be substantially similar, except to the extent that the Authority considers that —
it is not practicable to make them substantially similar; or
a difference is necessary to reflect particular supply circumstances.
Terms and conditions determined under subsection (1) must not be inconsistent with —
any other terms and conditions provided for in this Act or the regulations that apply to the licence; or
the electricity system and market rules; or
the Code; or
in the case of a licence that relates to a Pilbara network —
the Pilbara Networks Access Code, if the network is regulated under Part 8A; and
the Pilbara networks rules, if they apply to the network;
or
regulations made under the Electricity Act 1945 section 32.
