Withdrawal of complaint
29 Withdrawal of complaint
A person who complains to the Director may at any time withdraw the complaint by notifying the Director, and the Director must then —
stop dealing with the complaint; and
if notice has been given under section 35(1), notify the provider or other person of the withdrawal.
Despite subsection (1)(a), the Director may decide to proceed to deal with the complaint under this Act if the complaint alleges 1 or more of the matters set out in section 25(1)(i), (j) or (k).
If the Director decides under subsection (2) to proceed to deal with the complaint, the Director is not required to —
give notice of the withdrawal under subsection (1)(b); or
provide to the person who complained any further information under another provision of this Act that would otherwise require the provision of information to the person.
