Evidence and witnesses

In force

(1)

In conducting an inquiry, the Board must give the respondent an opportunity to —

(a)

call and give evidence; and

(b)

examine and cross‑examine witnesses; and

(c)

make submissions.

(2)

Subsection (1) does not apply if —

(a)

the Board has adopted any findings, decisions, judgment or reasons for judgment under section 93; and

(b)

the respondent has been given the opportunity referred to in subsection (1) by a court, tribunal or other body referred to in section 93.
