94 Inquiry powers
For the purposes of an inquiry, the Board may —
by written direction given to a person, require the person —
to attend at a place and time specified in the direction; or
to produce at a place and time specified in the direction a document or other thing that is in the person’s possession or under the person’s control;
and
direct a person attending in response to a direction under paragraph (a)(i) —
to give such information as is requested in relation to any matter; or
to answer a question put to the person.
The Board may —
inspect a document or other thing produced in response to a direction under subsection (1)(a)(ii) and retain it for any reasonable period that the Board considers appropriate; or
make a copy of a document produced in response to a direction under subsection (1)(a)(ii); or
direct that any information or answer directed to be given under subsection (1)(b) be given on oath or affirmation or be verified by statutory declaration.
A Board member may administer an oath or affirmation for the purposes of this section.
If the Board gives a direction to a person under subsection (1)(a), the direction must state that —
under this Act, the person is required to comply with the direction; and
failure to do so may be an offence under section 95(1).
If the Board gives a direction to a person under subsection (1)(b), the Board must inform the person that —
under this Act, the person is required to comply with the direction; and
failure to do so may be an offence under section 95(1).
