The director‑general need not give notice under section 76 before suspending a biosecurity permit—

if the director‑general is satisfied that the suspension is required urgently because of the biosecurity impact of the conduct authorised by the permit; or

in an emergency; or

for any other reason prescribed by regulation.

However, if the director‑general suspends a permit without giving prior notice, the director‑general must give the permit‑holder a written notice stating—

the grounds for the suspension; and

that the permit‑holder may, by a stated day that is at least 28 days after the day the notice is given to the permit‑holder, make a submission to the director‑general about the suspension.

If the permit‑holder makes a submission before the stated day, the director‑general must—

consider the submission; and

decide whether to revoke or continue the suspension; and

give the permit‑holder written notice of the decision.
