33 Officers

(1)

The commissioner may appoint an adult to be an officer for this Act, or any other Act under which the commissioner exercises a function.

Note 1 For the making of appointments (including acting appointments), see Legislation Act 2001, pt 19.3.

Note 2 In particular, a person may be appointed for a particular provision of a law (see Legislation Act 2001, s 7 (3)) and an appointment may be made by naming a person or nominating the occupant of a position (see s 207).

(2)

The officers so appointed include, but are not limited to, the following officers:

(a)

the officer in charge of a polling place;

(b)

the officer in charge of a scrutiny centre;

(c)

an officer for the purposes of a poll or the scrutiny at an election.

(3)

A candidate is not entitled to be appointed as an officer, and an officer vacates office if they become a candidate.

(4)

The commissioner has all the powers of an officer and, in the exercise of such a power, is subject to the same obligations as an officer and, for this Act, shall be taken to be an officer.

(5)

Subject to the directions of the OIC, an officer at a polling place or scrutiny centre may exercise any of the powers of the OIC and in so doing shall, for this Act, be taken to be the OIC.
