34 Payment of damages to Commonwealth

(1)

Where the requirements of a notice given to a person under subsection 107T(1) or (2) of the Repatriation Act had not been complied with before the commencing date, section 76 of the Veterans’ Entitlements Act applies, on and after that date but subject to subsection (2) of this section, as if the notice were a notice given to the person by the Commission under that section.

(2)

The amount payable to the Commonwealth in pursuance of a notice to which subsection (1) applies shall not exceed the amount specified in that notice.
