38 Notification of event or change of circumstances
Where an event or change of circumstances of a kind described in subsection 124(4) or (5) of the Veterans’ Entitlements Act occurred before the commencing date:
if the last day on which the person in receipt of a service pension, a wife’s service pension, a carer’s service pension or rent assistance could have notified the occurrence of that event or change of circumstances as required by the provisions of the Repatriation Act or of a notice under that Act is a day on or after the commencing date—the provisions of those subsections extend to that event or change of circumstances; or
if that last day was a day before the commencing date—section 98AAA of the Repatriation Act continues, notwithstanding the repeals effected by subsection 3(1) of the Veterans’ Entitlements Act, to apply to that event or change of circumstances.
