73 Placement where compliance with expressed wishes of parent or guardian impracticable
Despite clauses 71 and 72, if compliance with an expressed wish of a parent or guardian referred to in those clauses is impracticable, the relevant decision-maker may give written authorisation for the placement of the child with another approved person.
The relevant decision-maker must—
inform, or make reasonable efforts to inform, the parent or guardian before placing the child, and
if the relevant decision-maker is unable to inform the parent or guardian before placement, continue to make reasonable efforts to inform the parent or guardian until filing of the application for an adoption order in respect of the child, and
include in the relevant decision-maker’s report to the Court under section 91 of the Act a statement of the reasons why he or she authorised such a placement and of the efforts made to inform the parent or guardian.
