Secretary may require licensee or manager of any licensed premises to hold recognised competency card with licensee endorsement or advanced licensee endorsement
69 Secretary may require licensee or manager of any licensed premises to hold recognised competency card with licensee endorsement or advanced licensee endorsement
It is a condition of a licence that the licensee or manager of the licensed premises must hold a recognised competency card with a current licensee endorsement or a current advanced licensee endorsement (or both) if required to do so by the Secretary by notice in writing.
The notice may specify the period within which the recognised competency card must be obtained. The Secretary may, by further notice, extend any such period.
In deciding whether to require a licensee or manager to hold a recognised competency card with a current licensee endorsement or a current advanced licensee endorsement (or both), the Secretary must consider whether the training required to obtain the recognised competency card will be effective in reducing the risk of alcohol-related violence or anti-social behaviour on or about the licensed premises.
The Secretary may only require a licensee or manager of licensed premises to hold a recognised competency card with a current advanced licensee endorsement if—
liquor is authorised to be sold, supplied or served on the licensed premises after midnight on a regular basis, or
(Repealed)
the relevant licence has, within the previous 6 months, been suspended or cancelled under Division 4 of Part 7 of the Act.
