Passenger Transport Act 2014

TfNSW may, by order published in the Gazette, determine terms and conditions for the use of smartcards.

Without limiting subsection (1), an order published under subsection (1) may make provision for terms and conditions relating to the following—

payments for, and the use of, smartcards as an authority to travel,

the validity, cancellation, registration and expiry of smartcards,

the transfer, refund and forfeiture of smartcard balances,

requiring proof of use of, and proof of entitlement to use, smartcards,

exculpating TfNSW from liability, or otherwise limiting the liability of TfNSW, in connection with the use of smartcards.

An order published under subsection (1) may—

apply generally or be limited in its application by reference to specified exceptions or factors, and

apply differently according to different factors of a specified kind.
