This clause applies to the following land in Caringbah—

Lots 36–41, DP 15573, 6–16 Hinkler Avenue,

Lots A and B, DP 35462, 18–20 Hinkler Avenue,

Lots 10–15, DP 15573, 319–329 Taren Point Road,

Lots 1 and 2, SP 70334, 331 Taren Point Road,

Lot D, DP 35462, 333 Taren Point Road.

Despite clause 4.3, the maximum height of a building on land to which this clause applies is 60m.

Despite clause 4.4, the maximum floor space ratio of a building on land to which this clause applies is 3.9:1.

Subclauses (2) and (3) do not apply unless the consent authority is satisfied at least 15% of the gross floor area of all buildings will be used for affordable housing for at least 15 years.

This clause ceases to have effect on 30 June 2026.
