922 Contempt by witness

(1)

A person must not, without lawful authority or excuse—

(a)

if called to appear before an industrial tribunal—disobey the attendance notice requiring the appearance; or

(b)

if appearing before an industrial tribunal, whether or not in response to an attendance notice—

(i)

refuse to be sworn or to make an affirmation or declaration as a witness; or

(ii)

refuse to answer a question the person is required by the tribunal to answer; or

(iii)

refuse to produce records the person is required by the tribunal to produce.

Maximum penalty—40 penalty units.

(2)

In this section—

industrial tribunal means the commission, an Industrial Magistrates Court or the registrar.
