A person must not, for this Act, give an official a document containing information the person knows is false or misleading in a material particular.Maximum penalty—40 penalty units.
Subsection (1) does not apply to a person if the person, when giving the document—
informs the official, to the best of the person’s ability, how it is false or misleading; and
if the person has, or can reasonably obtain, the correct information—gives the correct information.
A person must not make an entry in a document required or permitted to be made or kept under this Act knowing the entry to be false or misleading in a material particular.Maximum penalty—40 penalty units.
It is enough for a complaint against a person for an offence against subsection (1) or (3) to state that the statement made was ‘false or misleading’ to the person’s knowledge.
A person must not be prosecuted for an offence against this section if the person can be prosecuted for an offence under section 488.
In this section—
official means any of the following—
an inspector;
an authorised industrial officer;
the registrar.
