931 Offence to offer or accept premiums

(1)

This section applies subject to section 400.

(2)

A person must not—

(a)

offer an employment premium; or

(b)

demand an employment premium; or

(c)

ask for an employment premium; or

(d)

accept, or agree to accept, an employment premium.

Maximum penalty—16 penalty units.

(3)

If a court finds a person (the defendant) guilty of accepting an employment premium, it must, in addition to any penalty order it may make, order the defendant to pay an amount, equivalent to the amount or value of the premium, to the person from whom the defendant accepted the premium.

(4)

In this section—

employment premium includes a consideration, gift, allowance or forbearance for the employment of a person.
