Water and Sewerage Industry Act 2008

An application under section 79(1) may be made only on one or more of the following grounds:

the Regulator made an error of fact in his or her findings of facts, and that error of fact was material to the making of the decision;

the Regulator made more than one error of fact in his or her findings of facts, and those errors of fact, in combination, were material to the making of the decision;

the exercise of the Regulator's discretion was incorrect, having regard to all the circumstances;

the Regulator's decision was unreasonable, having regard to all the circumstances.
