87 Court's determination

The Court may make a determination in respect of the application to – affirm, set aside or vary the reviewable decision; or substitute a new decision for the reviewable decision; or remit the matter back to the Regulator to make the decision again, in accordance with any direction or recommendation of the Court.

For the purposes of making a determination of the kind in paragraph (a) or (b), the Court may perform all the functions and exercise all the powers of the Regulator under this Act.

A determination by the Court affirming, setting aside or varying the reviewable decision is, for the purposes of this Act (other than this Part), to be taken to be a decision of the Regulator.
