40 Dunes
(1)
Subject to subregulation (2), a dune or a source bordering dune is an area of cultural heritage sensitivity.
(2)
If part of a dune or part of a source bordering dune has been subject to significant ground disturbance, that part is not an area of cultural heritage sensitivity.
(3)
In this regulation—
dune includes an inland, riverine, lacustrine or coastal dune;
source bordering dune means an area identified as "Qdi" in the Surface Geology of Victoria 1:250 000 map book.
