122 Entitlement to compensation for property loss and damage
A member is entitled to compensation for destruction, damage or loss occurring in the course of, or arising out of, performing service as a member in relation to—
wearing apparel or personal effects worn while performing the service; or
a motor vehicle, equipment or property owned by, or in the possession of, the member and used in the performance of the service.
Despite subregulation (1), a member is not entitled to compensation in respect of destruction, damage or loss of—
an aircraft; or
an unregistered motor vehicle that is used on a highway.
In this regulation—
highway has the same meaning as in the Road Safety Act 1986;
unregistered motor vehicle means a motor vehicle which is not registered under Part 2 of the Road Safety Act 1986 or a corresponding law of another State or a Territory.
