Social Services Regulations 2023

For the purposes of section 48(2)(c) of the Act, the following incidents are prescribed—

the unexpected death of a service user;

an incident (other than an incident referred to in section 48(2)(a) or (b) of the Act) that results in serious injury to a service user who is a resident of a supported residential service.

For the purposes of section 48(3)(b) of the Act, the following information is prescribed—

the name of the registered social service provider;

the name and type of social service to which the serious incident relates;

the address for delivery of the social service;

the details of the incident, including—

a description of the incident; and

where the incident occurred; and

the date and time the incident occurred;

details of any service users or other persons involved in or affected by the incident;

details of the registered social service provider's actions to address the immediate health and safety of persons involved in, or impacted by, the incident;

whether any of the following have been notified of the incident—

a service user's guardian;

a service user's next of kin;

if a service user is a resident of a supported residential service, the service user's person nominated under section 216 of the Act (if any);

the name and contact details of the person notifying the Regulator of the incident;

if notice of the incident is given in writing—

the signature of the person giving the notice; and

a declaration by that person verifying the accuracy of the information given in the notice.

In this regulation—

physical injury;

psychological injury;

endangers life; or

is substantial.
