16 Application of section 145B to acts or omissions before commencement
Section 145B extends to anything done or omitted to be done before the commencement of Schedule 1[1] to the Environmental Planning and Assessment Amendment (Contaminated Land) Act 1996 if—
(a)
the thing was done or omitted to be done substantially in accordance with planning guidelines relating to contaminated land published before that commencement, and
(b)
those guidelines were notified in a manner that, had section 145C been in force, would have complied with subsection (1) of that section (whether or not the notification complied with subsection (2) of that section).
