Planning Act 1999

The Minister may terminate the appointment of a member of the

Development Consent Authority for any of the following reasons:

demonstrated inability to perform the functions of office;

misbehaviour or a failure to abide by a code of conduct established under section 100;

physical or mental incapacity.

The Minister must terminate the appointment of a member of the

Development Consent Authority if:

the member is absent from 3 consecutive meetings of the

Development Consent Authority without leave from:

in the case of the Chair – the Minister; or

in the case of a member other than the Chair – the Chair; or

the member becomes bankrupt, applies to take the benefit of any law for the relief of bankrupt or insolvent debtors, compounds with creditors or makes an assignment of remuneration for their benefit;

or

the member is a community member and the local government council requests that the member's appointment be terminated.

If the Minister terminates the appointment of a community member, the Minister must give written reasons for the termination to the member and the local government council that nominated the member.
