98 Offences related to non-disclosure of interest
A person commits an offence if:
the person is a member of the Development Consent Authority; and
the person intentionally attends, contributes to or takes part in a deliberation or decision of the Division of which the person is a member; and
the deliberation or decision is in relation to an interest or relationship referred to in section 97(1); and
the person recklessly fails to disclose that interest or relationship.
Maximum penalty: 50 penalty units.
A person commits an offence if:
the person is a member of the Development Consent Authority; and
the person intentionally attends, contributes to or takes part in a deliberation or decision of the Division of which the person is a member; and
the person has an interest or relationship referred to in section 97(1) and is reckless in relation to that circumstance.
Maximum penalty: 50 penalty units.
Strict liability applies to subsections (1)(a) and (c) and
(a).
It is a defence to a prosecution for an offence against subsection (2) if the Chair determined under section 97(5) that the defendant could be present during, contribute to or take part in the deliberation or decision of the Division.
