71 Payments, &c. to Public Trustee pursuant to court orders

(1)

If a court has adjudged, ordered or decreed that money be paid, or property, real or personal, be delivered up or transferred to a party to a cause or matter, or to any other person, that court may direct in its judgment, order or decree that such money or property be paid, delivered up or transferred to the Public Trustee on behalf of such party or other person.

(2)

The Public Trustee shall, where an order under subsection (1) is served upon him or her, accept payment, delivery or transfer, as the case may be, of the money or property and the acceptance shall be a sufficient discharge to the person paying, delivering or transferring that money or property.

(3)

The Public Trustee shall hold money or property accepted under this section upon trust to apply the same and the income from it in the manner and for the benefit of the party or other person directed in the judgment, order or decree, or in such manner and for the benefit of such person as the court by which the judgment, order or decree was made, may from time to time direct.

(4)

Subject to any direction of the court by which the judgment, order or decree was given or made, the Public Trustee shall have all rights and powers, and shall undertake all duties and liabilities, of a trustee, subject and according to the provisions of this Act, in relation to the money or property.

(5)

In this section court means any court, or person acting judicially, exercising jurisdiction either within or outside the Northern Territory.
