87 Execution under power of attorney

(1)

Where the Public Trustee executes any document under a power of attorney, no person shall require him or her to furnish evidence by way of statutory declaration that no notice of revocation of the power of attorney by death or otherwise has been received by the

Public Trustee.

(2)

The execution by the Public Trustee of a document under a power of attorney shall be accepted by all persons as proof of the nonrevocation of the power of attorney at the time when the document had been executed.

(3)

The Public Trustee acting in pursuance of a power of attorney shall not be liable for his or her actions by reason only of the fact that, at the time of the action, the person who gave the power of attorney was dead or had done some act to avoid the power of attorney, provided that this fact was not known to the Public Trustee at the time of his or her so acting.
