42 Financial arrangements
An account called the Botanic Gardens and Parks Foundation Account is to be established —
as an agency special purpose account under section 16 of the Financial Management Act 2006; or
with the approval of the Treasurer, at a bank as defined in section 3 of that Act,
to which the funds received by the Foundation are to be credited.
The Foundation Account is to be charged with all expenditure lawfully incurred by the Foundation in the performance of its functions.
Moneys standing to the credit of the Foundation Account —
are subject to the direction and control of the Authority; and
may be transferred to the Authority for the purposes of carrying this Act into effect or otherwise applied for the purposes of the Authority or the Foundation.
The operation of the Foundation Account is to be regarded as —
a service under the control of the Authority for the purposes of section 52 of the Financial Management Act 2006; and
part of the operations of the Authority for the purposes of Part 5 of that Act.
