50 Evidentiary provision — speed measuring equipment

(1)

In this section —

speed measuring equipment has the meaning given in the Road Traffic (Administration) Act 2008 section 117(1).

(2)

In proceedings for an offence against the regulations, evidence may be given of the use of speed measuring equipment by a park management officer in relation to a vehicle and of the speed at which that vehicle was moving as ascertained by the use of that equipment.

(3)

Evidence given under subsection (2) is, in the absence of evidence to the contrary, proof of the speed at which the vehicle was moving at the time of the use of the speed measuring equipment in relation to that vehicle.

(4)

In proceedings for an offence against the regulations, evidence by a park management officer that apparatus used by the officer was speed measuring equipment within the meaning of this section is, in the absence of evidence to the contrary, proof of that fact.

(5)

Nothing in this section prevents or restricts the introduction of any competent evidence, whether in addition to, or independent of, any evidence for which provision is made by this section, bearing on the question of whether a person is or is not guilty of an offence against the regulations.
