71A Criminal record checks

(1)

In this section —

Commissioner of Police means the person holding or acting in the office of Commissioner of Police under the Police Act 1892;

criminal record, in relation to a health care worker, means the criminal record of the health care worker kept by the Commissioner of Police;

relevant decision, in relation to a health care worker, means a decision whether to —

(a)

make an interim prohibition order in relation to the health care worker; or

(b)

make a prohibition order in relation to the health care worker; or

(c)

publish a public health warning statement in relation to the health care worker.

(2)

For the purposes of making a relevant decision in relation to a health care worker, the Director may —

(a)

request that the Commissioner of Police give the Director information concerning any criminal record of the health care worker; and

(b)

for the purpose of the request, give the Commissioner of Police any information concerning the health care worker that is necessary to conduct a check on the criminal record of the health care worker.

(3)

On a request under subsection (2), the Commissioner of Police may give the information sought to the Director.
