42 Legal proceedings
(1)
This section applies if —
(a)
the FOI Act Information Commissioner is a party to any legal proceedings arising under, or in relation to the administration of, the Freedom of Information Act 1992; and
(b)
the proceedings have commenced, but not been finally determined, before transition day.
(2)
On and from transition day, the new Information Commissioner is taken to be a party to the proceedings instead of the FOI Act Information Commissioner.
