37A Conflict or inconsistency between conditions imposed under Health Practitioner Regulation National Law (Western Australia) and this Act

(1)

If there is any conflict or inconsistency between a condition —

(a)

imposed on a medical radiation practitioner under the Health Practitioner Regulation National Law (Western Australia); and

(b)

imposed on a licence held by the medical radiation practitioner under this Act,

then —

(c)

the condition imposed on the licence prevails (whether that condition was imposed before or after the condition imposed under the Health Practitioner Regulation National Law (Western Australia)); and

(d)

the condition imposed under the Health Practitioner Regulation National Law (Western Australia) is of no effect to the extent of the conflict or inconsistency.

(2)

For the purposes of subsection (1), a conflict or inconsistency does not exist merely because the condition imposed under the Health Practitioner Regulation National Law (Western Australia) imposes more stringent measures or a higher duty or standard in respect of a particular matter or aspect of practice.
