11I Deciding application

(1)

The Commissioner must decide an application on the information available to the Commissioner.

(2)

Subsection (1) does not limit another provision of this Act that provides for matters the Commissioner must consider or be satisfied of in deciding the application.

(3)

The Commissioner cannot decide the application before the later of the following days —

(a)

the day stated in a notice given to any party to the application under section 11F or 81Q as the day by which a submission must be given to the Commissioner to be considered in deciding the application;

(b)

the day stated in a notice given to any party to the application under section 11G as the day by which the requirement under the notice must be complied with.

(4)

The powers of the Commissioner under section 11B do not apply for the purposes of deciding the application.

(5)

This section does not apply if the Commissioner declines to decide the application under section 11L.
