41 Registration
This section applies if the commissioner—
conducts a risk assessment or a revised risk assessment for a person; and
is satisfied that the person poses no risk or an acceptable risk of harm to a vulnerable person (a positive risk assessment).
The commissioner must—
register the person; and
tell the person, in writing—
of the positive risk assessment; and
that the person is registered; and
the person’s unique identifying number; and
if the registration is conditional under section 42A (Conditional registration—class A disqualifying offence or negative status under corresponding law)—
what the condition is; and
the reasons for the condition; and
the day the registration ends; and
anything else prescribed by regulation; and
if the registration is conditional under section 42A—tell the named employer (if any) in writing—
that the person’s registration is conditional; and
what the condition is.
For subsection (2) (c), the commissioner must not, without the person’s consent, tell the named employer the reasons for the condition.
Registration must be for not longer than 5 years.
