Working with Vulnerable People (Background Checking) Act 2011

The commissioner may give an employer the following information about a person the employer is associated with:

the person’s name;

the status or outcome of the person’s application for registration;

if the person is registered—

the unique identifying number for the person; and

the date the person’s registration ends; and

whether the person’s registration is subject to conditions under section 42 or section 54A;

anything else prescribed by regulation.

For subsection (1) (c) (iii), the commissioner—

need not tell the employer what the person’s condition is; and

must not, without the person’s consent, tell the employer the reason for the condition.

In this section, an employer is associated with a person if—

the person is registered or has applied for registration; and

the employer engages, or intends to engage, the person in a regulated activity for which the person is required to be registered.
