55 Application for designation of ELR
(1)
The holder of an EL with a title area in or comprising the existing title area or existing proposed title area of an EMEL (the
EMEL area) is entitled to apply for the designation of an ELR for any of the EMEL area that does not also comprise the title area or proposed title area of a development title (the development area).
(2)
Subregulation (1) does not prevent the holder of the EL from applying for the designation of an ELR for any of the EMEL area surrounding the development area.
