21Y Protection of information
A person must not, directly or indirectly, record, use or disclose information obtained because of a function the person has or had under this Part, except as permitted under subsection (2).
Penalty for this subsection: a fine of $50 000.
The person may record, use or disclose the information —
for the purpose of performing a function under this Part; or
to the Minister or the Commission; or
as required under this Act or another written law; or
to a court or person or body acting judicially in the course of proceedings before the court, person or body; or
under an order of a court or person or body acting judicially; or
for the purposes of investigating a suspected offence or the conduct of proceedings against a person for an offence.
