35 Application of chemical dispersant to oil spills

A person must not apply chemical dispersant to an oil spill that has arisen as a result of an activity unless —

(a)

the Minister, or the appropriate hazard management agency prescribed under the Emergency Management Act 2005, has given written consent to the application of chemical dispersant; and

(b)

if the consent under paragraph (a) is given subject to any conditions — those conditions are complied with.

Penalty: a fine of $10 000.
