40 Minister may decline to consider submission if information not given
(1)
The Minister may decline to consider a submission made under Part 2 by the operator of an activity until —
(a)
the instrument holder for the activity complies with regulation 37; or
(b)
the operator of the activity complies with regulation 38.
(2)
Subregulation (1) does not apply if the information has already been given in accordance with the Act or another written law.
